What changes for a Lac-Beauport household when one adult is a permanent resident, not a citizen

THE SHORT ANSWER

Canadian permanent residence is a Canadian immigration status; it does not make a person Canadian for U.S. purposes. A permanent resident holding another country's passport is assessed under that nationality for TN, E-2 and visa requirements. Within one Lac-Beauport household this can mean the Canadian-citizen spouse qualifies for TN while the permanent-resident spouse does not, or that an E-2 enterprise must be structured around the citizen's ownership. Identify each adult's nationality before any route is chosen, and record any pending citizenship application as pending rather than as a status.

01

Sort the household by passport, not by address

Hypothetical example: a Lac-Beauport software developer who is a French citizen with Canadian permanent residence is married to a Canadian citizen who works as a dietitian. Both commute to Québec City. The dietitian, as a Canadian citizen in a listed profession, can pursue TN and apply at a port of entry without a visa. The developer cannot use TN, because the category is limited to Canadian and Mexican citizens; a Canadian PR card does not substitute. He may, however, qualify as a French national for E-2, since France is a treaty country, or for an H-1B or L-1 depending on the employer. The point is that the household's two U.S. options come from two different nationality analyses, and a plan built as if both were Canadian would send the developer to the border with a file that cannot succeed.

02

Trace what nationality changes in each category

TN is restricted to Canadian and Mexican citizens; permanent residence is irrelevant. E-2 requires the investor and at least half of the enterprise's ownership to hold treaty-country nationality, so a permanent resident's own citizenship must be checked against the treaty list, and a Canadian-citizen spouse's ownership may be what gives the enterprise treaty nationality. L-1 has no nationality requirement, but a non-Canadian transferee needs a visa stamp at a consulate before travel, adding time. EB-5 and the Gold Card framework have no nationality bar, but the applicant's country of chargeability for the Visa Bulletin is normally the country of birth, not of residence or citizenship, which affects the wait for a visa number. For each adult, write the nationality, the country of birth and the consequence in each category on one page.

03

Handle pending and dual situations carefully

A pending Canadian citizenship application is a fact to record, not a status to claim. If the permanent-resident spouse expects citizenship within months, it may be worth waiting before a TN attempt, but the household should not rely on an estimated ceremony date to time a resignation. Dual nationals should present the nationality that supports the category: a Canadian-French dual citizen can use Canadian citizenship for TN and French or Canadian nationality for E-2, but must be consistent within any single application. Children born in Canada to a permanent-resident parent are Canadian citizens and are assessed as such; children born abroad may hold a different nationality from a sibling, which matters for TD and derivative applications.
