A Lac-Beauport dentist selling a practice: EB-5 capital or a Gold Card gift?

THE SHORT ANSWER

EB-5 and the Gold Card framework both lead toward permanent residence for a person with substantial funds, but they treat the money differently. EB-5 places capital at risk in a U.S. enterprise that must create ten jobs, with any repayment depending on the offering terms and project performance. The Gold Card, as described on the official page, involves a nonrefundable processing fee and a gift to the U.S. government with no enterprise, no jobs and no return. Compare them as what they are: an investment with immigration conditions versus a payment with immigration consequences. Re-verify the official terms before either decision.

01

Compare where the money ends up

Hypothetical example: a Lac-Beauport dentist sells a practice and, after Canadian tax, has liquid proceeds that could fund either route. Under EB-5 the required amount, currently US$1,050,000 or US$800,000 for a targeted employment area or infrastructure project, is invested in a new commercial enterprise, usually through a regional-center fund. It remains at risk for the required period, may be lost if the project fails, and may be returned with or without gain if it succeeds. Under the Gold Card framework, the applicant pays a nonrefundable fee and makes a gift to the U.S. government; the gift is not held for the applicant and is not returned in any scenario. The dentist should therefore model EB-5 as a risky, illiquid investment and the Gold Card as a consumed expense.

02

Compare what must be proven and by whom

EB-5 imposes evidentiary obligations on both the investor and the project. The investor must document the lawful source and path of every dollar, must show engagement in management or policy, and must later prove the investment was sustained and the jobs were created in order to remove conditions. The project must be a genuine new commercial enterprise with a credible job-creation model, and regional centers must maintain their designation and compliance under the 2022 Act. The Gold Card framework, as described officially, involves vetting and an eligibility determination under an existing employment-based category, subject to visa availability, with the applicant's admissibility assessed as in any immigrant case. It carries no job-creation or sustainment obligation, but it also gives the applicant no control over the underlying category's requirements.

03

Decide on certainty, time and reversibility

EB-5 is a statutory category with known procedures: petition, visa availability, conditional residence, removal of conditions. The Gold Card is a new framework whose official terms have been described as subject to change; its timeline depends on vetting and on the underlying category, and no reliable duration can be stated. Reversibility also differs: an EB-5 investor whose petition is denied may recover capital depending on the offering's terms, while a Gold Card applicant refused after payment does not recover the fee and should not expect to recover the gift. The dentist should decide which uncertainty is more tolerable, commercial risk with a defined legal process, or legal novelty with a defined financial loss, and should record the official page's terms with the date they were read before making any transfer.
