FOR PROFESSIONALS · LAC-BEAUPORTLac-Beauport

Your talent.A bigger stage.

For many Lac-Beauport residents who work in Québec City's hospitals and clinics, TN is the first category an employer mentions. It applies to Canadian and Mexican citizens taking prearranged professional work in an occupation listed in Appendix 2 of USMCA Chapter 16, and each listed occupation carries its own qualification rule. Several health professions on that list require a state or provincial licence in addition to a degree, and the U.S. employer's willingness to hire does not replace the licence. The practical question for a health professional is therefore not whether the job is real but whether the credential the profession demands is already in hand, and if not, how long it will take and who must issue it.

IN THIS GUIDE · Let the state licence, not the offer letter, decide whether a Lac-Beauport health professional has a TN case

Start with the TN eligibility and application overview

01

Identify which credential the profession actually names

Hypothetical example: a Lac-Beauport occupational therapist receives an offer from a U.S. rehabilitation chain that promises to sponsor TN status. The Appendix 2 entry for occupational therapists accepts a degree or a state or provincial licence. Her Québec order membership may satisfy the entry, yet the employer's state may still require its own licence before she can treat patients, which is a practice question rather than an immigration one. Both must be answered, and confusing them leads to arriving legally and being unable to work.

02

Ask the employer for the facts the officer will ask about

Request a support letter that states the position, the profession it corresponds to, the duties, the remuneration, the intended period and the reason the applicant qualifies. If the employer's letter merely repeats the job title, ask for revisions before travel. A letter drafted by human resources for a general hire often omits the specific USMCA language, and an officer at a port of entry cannot infer what is not written.

03

Disclose ownership and rule out self-employment

TN does not permit self-employment in the United States. A Lac-Beauport consultant who would bill the U.S. client through a personal corporation is in a different position from an employee on the client's payroll, even if the work is identical. Disclose any shareholding in the employing entity and any arrangement where the applicant controls the engagement. The answer may still be favourable, but it must be reviewed on the real structure.

04

Choose the admission route deliberately

A Canadian citizen may present the file at a port of entry or preclearance location, or the employer may file Form I-129 with USCIS in advance. Applying at the border is faster but leaves no room for a follow-up request; a petition takes longer but produces a written approval before resignation. For a health professional whose licence is still pending, the petition route can sometimes be sequenced so that approval and licence arrive together.

05

The credential attached must match the profession’s own rule

Requesting transcripts, ordering a credential evaluation, asking the institution to restate the appointment terms and having counsel assess the proposed profession can each be repeated or corrected at no lasting cost. The single record that settles a contested field is the institution’s official program description for the year the credential was granted, held by the registrar rather than by the applicant. Match each claimed requirement to a primary record: diploma, transcript, licence where relevant, and a credential evaluation where the rule calls for one.
