IN THIS GUIDE · Document the path of a Lac-Beauport retiree's capital before evaluating any EB-5 project
Start with the EB-5 eligibility and application overview
Build the chronology from the oldest record forward
Hypothetical example: a Lac-Beauport retired public-sector executive intends to fund an EB-5 investment from a commuted pension value, the sale of a family home and a brokerage account built over twenty years. Each stream needs its own paper trail: the pension statement and transfer record, the property deed, listing, sale agreement and closing statement, and brokerage statements reaching back far enough to show the account's growth was from documented contributions. Tie each stream to a bank account, and each account to the final wire.
Distinguish the project's promises from its documents
A regional-center presentation is marketing. The documents that matter are the private placement memorandum, the subscription agreement, the escrow agreement, the job-creation methodology and the regional center's designation and compliance status. Read the redemption and return terms carefully: capital must remain at risk, so any guaranteed repayment undermines the case.
Count jobs the way the regulation counts them
Ten full-time positions for qualifying U.S. workers, created within the required window, are the condition on which permanent residence ultimately depends. In a regional-center project, indirect and induced jobs may count under an economic model; in a direct investment, only the enterprise's own payroll counts. Ask which model applies, how many jobs are allocated to each investor, and what happens if the project underperforms.
Plan the two-stage residence honestly
Approval of the immigrant petition leads to conditional permanent residence for the investor, spouse and unmarried children under 21, whether obtained by consular processing or adjustment of status. Within the ninety days before the two-year anniversary the investor files to remove conditions with proof of sustained investment and job creation. A Lac-Beauport family should plan for the possibility that the project's job count is not complete at that point and understand the consequences.
Standalone counting differs from a regional center
The permitted methods of counting jobs are not identical between the two, so a model borrowed from a regional center offering may not support a direct operating company. Standalone and regional-centre proposals use different evidence frameworks, and a regional-centre designation does not guarantee commercial or immigration success. Begin with the offering materials and business plan, then match the employment method to payroll records, economic inputs, or other project evidence as applicable. A promoter's assertion that a site is rural or high-unemployment is a claim to be verified against the current designation, not a fact established by the marketing deck. The conditional-residence period and the later removal-of-conditions filing are not reset by a delayed construction milestone or an investor’s preferred relocation schedule.
