THE SHORT ANSWER

Hypothetical example: a senior executive at a distribution company in Saint-Augustin-de-Desmaures, a few years from retirement with a liquid portfolio, is weighing an EB-5 regional-center investment against the individual Gold Card. EB-5 places US$1,050,000, or US$800,000 in a qualifying targeted employment area, at risk in a job-creating enterprise and leads to two-year conditional residence. The Gold Card, per the official FAQ recorded September 7, 2026, involves a US$1 million gift and a US$15,000 nonrefundable fee, leading to EB-1 or EB-2 permanent residence for eligible applicants. The right questions concern liquidity, tax and what the money does.

01

Ask what happens to the money in each case

Under EB-5 the capital is invested at risk; it may be returned years later if the project repays, may be lost, and must remain at risk through the conditional period. Under the Gold Card framework the amount is a gift to the U.S. government; it is not returned, earns nothing and creates no claim on any enterprise, and the processing fee is nonrefundable whatever the outcome. An executive comparing the two should therefore compare a possibly-recoverable illiquid investment with a certain outflow, and should ask a financial adviser, not an immigration adviser, whether the portfolio can absorb either. Neither route should be described as buying a result; both preserve eligibility, admissibility and visa availability as separate conditions.

02

Ask what each route requires the applicant to prove

EB-5 demands a fully documented lawful source and path of funds, evidence that the enterprise will create ten full-time jobs attributable to the investor, and participation in management or policy; the regional center supplies the project file, but the investor is responsible for the petition. The Gold Card framework, as officially described, involves an application, vetting, further USCIS instructions on forms and evidence, and then the gift; the executive must still be eligible under EB-1 or EB-2 as determined by the authorities. Ask counsel which classification the executive's own record would support, because if the answer is an ordinary employment-based petition on his own merits, the gift may be paying for something available without it.

03

Ask how long each path keeps the family in Canada

EB-5 runs through petition adjudication, visa availability under the Visa Bulletin, an immigrant visa or adjustment step, two years of conditional residence and a removal-of-conditions petition; the family's permanent status is settled only at the end. The Gold Card framework leads, for eligible applicants, to an immigrant classification whose visa availability is also governed by the Bulletin, and general processing language on the official site is not an individual promise. For each route list the family members and birth dates, note whether a child could reach 21 before the process ends, and take the tax consequences of a gift versus an investment to a cross-border adviser before any funds move. Reread the official Gold Card instructions on the day of decision, since the recorded terms are dated.
