SAINT-AUGUSTIN-DE-DESMAURES · PERMANENT-RESIDENCE COMPARISON

Separate a commercial investment from a Gold Card gift

USAvisa field guide · 3 minute read Reviewed 7 September 2026
THE SHORT ANSWER

EB-5 and Gold Card describe genuinely different financial and legal frameworks. EB-5 concerns qualifying capital and required job creation; the official Gold Card FAQ describes a gift-based process leading to EB-1 or EB-2 permanent residence for eligible successful applicants, subject to admissibility and visa availability. Compare the actual requirements rather than reading the two headline amounts as prices for the same outcome. The central choice is whether the family accepts commercial investment risk tied to job creation or a gift payment that creates no investment ownership. Hypothetical example: a Québec owner of a commercial beekeeping business has liquid proceeds and is comparing an EB-5 project with the Gold Card. EB-5 requires capital at risk and a job-creation path before conditional residence can be made permanent; the Gold Card is a payment by the applicant to the U.S. government, not a conventional visa or an investment. The money’s legal role should decide the comparison.

01

Ask what the money is actually meant to do

Hypothetical example: a Québec City household receives an EB-5 investment presentation and a separate Gold Card proposal in the same period. Separate the investment's deployment, commercial risk and job-creation evidence from the gift and processing terms of the other route. Identify which costs are capital, which are fees, and which apply specifically to included family members, since a gift should never be described as an investment expected to produce a financial return. Use separate ledgers for capital, project charges, government fees, and payments that are permanently spent. A return projection for an EB-5 business interest cannot be carried over to a gift payment.

02

Review the family total and each person's eligibility

The official Gold Card FAQ specifies additional processing fees and gifts for included family members, so the principal's headline figure is not the whole household amount. EB-5 has its own family and timing analysis. List each person and have age, admissibility and visa-availability questions assessed individually, since neither a financial contribution nor an investor petition automatically preserves a child's eligibility. Calculate family eligibility and cash needs person by person, then test whether a child’s age, a spouse’s history, or a missing civil record changes either route. The principal’s amount is not automatically the household total.

03

Keep financial diligence and immigration review genuinely independent

Ask what evidence supports each legal claim, and which professional is actually assessing the commercial risk involved. A projected financial return cannot cure a missing immigration condition, and a well-prepared immigration file does not establish that an investment is financially sound. Recheck current official instructions before committing to either route, and treat promotional speed language or a stated willingness to pay as separate from any guaranteed approval or moving date. Run financial, source-of-funds, admissibility, and tax reviews independently before an irreversible commitment. Different due diligence is required because the investment and payment have different legal consequences.
