Your talent.A bigger stage.

Hypothetical example: a process engineer employed at a corrugated-packaging plant in Saint-Augustin-de-Desmaures is offered a twelve-month posting at a U.S. distribution centre. Her manager calls it a transfer; the American entity's letter calls it a new hire; and the duties paragraph mentions supervising a shift. Three documents, three different pictures. TN is available to Canadian or Mexican citizens for prearranged professional work in a profession listed in USMCA Appendix 2, and each profession has its own degree, licence or experience rule. The letter that describes what she will actually do each day is the one that decides whether TN is even the right question, so the review starts by reconciling the documents before anyone applies.

IN THIS GUIDE · Let the assignment letter, not the internal title, decide whether a Saint-Augustin-de-Desmaures engineer fits TN

Start with the TN eligibility and application overview

01

Identify the document that describes the job

Ask the U.S. entity for the letter it would actually hand to an officer: employer name, the professional position, the duties, the duration and the pay. Compare it with the Québec plant's internal transfer memo. Where the two disagree, the discrepancy is the finding. An engineer who spends most of the week supervising hourly staff is describing a supervisory job, and no rewording turns that into a listed engineering role. The reviewer needs the truthful version, then can say whether it fits.

02

Check the engineer rule, not a general degree rule

Engineer appears in Appendix 2 with its own qualification: a baccalaureate or Licenciatura degree, or a state or provincial licence. A Québec engineering degree meets the first branch; an Ordre des ingénieurs permit meets the second. Neither an MBA nor ten years of plant experience substitutes for those specific credentials. Have the transcript and, if used, the licence card ready in original form, and plan translation only for the document that carries the qualification.

03

Confirm who employs and who directs

TN does not permit U.S. self-employment, and it requires that a U.S. entity has arranged the professional work. When a Québec plant lends an engineer to a U.S. affiliate, decide and document whether the U.S. entity hires her directly or receives her services under an intercompany agreement, and which payroll she will sit on. Any ownership interest she holds in either company must be disclosed and reviewed against the self-employment restriction rather than left off the file.

04

Choose the admission route with the calendar in view

A Canadian citizen may present a TN application at a port of entry or preclearance location, or the employer may file Form I-129 with USCIS. Neither route is a formality; both apply the same substantive test. Look at her prior entries, any earlier denial and whether the household expects to pursue permanent residence later, because that longer plan is not erased by a twelve-month posting.
