L-1B concerns a qualifying transfer to perform work in a specialized-knowledge capacity. For a Québec City-based employee, the useful starting point is a plain description of what the person actually knows about the organization's product or processes and how the U.S. assignment will use that knowledge. Years of service, a hard-to-fill role, or general technical skill acquired at a Québec employer are not, by themselves, sufficient; the company relationship and qualifying foreign employment remain separate requirements that also need to be shown. The initial review should identify a specific body of company knowledge, where it resides, how it was acquired, and why the U.S. assignment needs it. The transferee must have worked for a qualifying organization for one continuous year in the preceding three years, and L-1B time is generally capped at five years.

IN THIS GUIDE · Explain the specific company knowledge behind a Québec City transferee's assignment

01

Name the knowledge instead of the person's reputation

The statutory standard concerns special knowledge of the company's product and its application in international markets, or an advanced level of knowledge of the company's own processes and procedures. Describe that knowledge in plain terms and connect it to specific evidence. It need not be described as unique or proprietary in every case; the file has to explain how it meets the applicable standard. Label the process, product, system, or methodology with enough precision that an outsider can test the claim. General praise for talent is not a substitute for records that show what is uncommon within the organization.

02

Show how the knowledge was learned and used

Gather training records, project examples and documentation of relevant responsibilities. Hypothetical example: a Québec City employee developed an internal deployment process through several projects and is now asked to introduce it to a U.S. team. Identify the training and work history that support that account while protecting genuinely confidential material appropriately. Sequence the proof from the underlying material to the employee’s exposure to it, then to the proposed U.S. use. That order makes it easier to see whether the knowledge belongs to the company and whether the assignment truly requires this worker.

03

Connect the knowledge to the specific U.S. assignment

Describe the proposed U.S. work, the expected activities, and how the claimed knowledge will actually be applied there. If the person will work at a client site, disclose who controls that work and the placement arrangement; the placement cannot be a labour-for-hire arrangement and must remain controlled by the petitioner. A customer's request or a technical-sounding title cannot substitute for a clear account of the actual duties. Describe the receiving team, its current capability, and the work that will change because of the transfer. A vague statement that the employee is important does not settle whether the duties use specialized knowledge.

04

Keep the underlying transfer conditions in view

Generally, one continuous year of qualifying employment abroad within the three years before the petition, plus a qualifying relationship between the organizations, must also be established. Preserve the employment dates, ownership records and operating evidence. Where the role looks primarily managerial or executive, compare it against L-1A on the actual facts rather than defaulting to L-1B as a catch-all label. L-1B status is subject to a five-year maximum. Confirm the corporate relationship and qualifying employment before investing heavily in technical exhibits. If either threshold record fails, a strong explanation of the technology cannot cure the transfer condition.
