IN THIS GUIDE · Licence or company knowledge: framing a L'Ancienne-Lorette aircraft-maintenance technician's L-1B
Start with the L-1B eligibility and application overview
Put the licence in its place
The licence and ratings prove he is competent to work on the aircraft type, and the affiliate needs that as a matter of aviation regulation. They do not prove specialized knowledge, because a licensed technician can be hired locally. State the licence once, as context, and do not build the case on it. The case is built on what the organization does that other maintenance organizations do not.
Describe the organization's own system
Set out the quality and documentation system in plain language: the internal procedures for task cards, the release process, the audit trail the organization maintains beyond regulatory minimums, and the internal training program. Show the technician's role in it, as author, trainer or auditor, with dated records. If the affiliate is adopting that system, explain why it cannot do so without him: he trained the Québec staff on it and will train the affiliate's staff. That is the specialized-knowledge account.
Prove the year and the relationship separately
Seven years with the organization exceeds the continuous year, but payroll for the last three years under the employer's legal name should be produced. The affiliate relationship is proved by ownership records showing common control; a shared approval certificate or a subcontract is not a qualifying relationship. Both organizations must be operating, with staff and customers.
Keep the assignment inside the category
If part of his work will take place at an airline customer's hangar, disclose it and show that the Québec organization or its affiliate controls his work and that he is not simply supplied as labour to the airline. L-1B is capped at five years. If the affiliate later wants him to manage its quality department, that is a managerial role assessed under L-1A on new facts.
Prove the transfer conditions that apply to every L-1
Where an L-1B employee would be stationed principally at a worksite other than the petitioner's, further conditions apply concerning who controls and supervises the work day to day and whether the arrangement amounts to labour for hire. Placement primarily at a third party's worksite is permitted only where the petitioner continues to control and supervise the work and the arrangement is not, in substance, labour for hire. A first review should make an individual knowledge matrix showing what the employee learned, where it was applied, why it matters to the related U.S. business, and what documents corroborate it. Processes change while someone is away, and a file claiming current advanced knowledge of a procedure introduced during the absence will not survive a question about when and how the person learned it.
