FOR IMMIGRANT INVESTORS · L'ANCIENNE-LORETTEL'Ancienne-Lorette

Invest in anew chapter.

EB-5 is an immigrant investor category built on qualifying capital and U.S. job creation. For a Québec City-based applicant, the first task is understanding the proposed investment structure and the records explaining the funds involved. The current standard minimum is US$1,050,000, reduced to US$800,000 for qualifying targeted employment area or infrastructure investments. That reduced figure is not available to every project, and meeting a capital amount alone does not establish eligibility. A first review should isolate four questions: the required capital amount, its lawful source and path, the commercial deployment, and the job-creation model. EB-5 capital must remain exposed to business risk and the route leads first to conditional residence; job creation is later tested when conditions are removed.

IN THIS GUIDE · Review the immigration evidence and the investment risk on their own terms

01

Connect the investment to the required job creation

The program generally requires at least ten permanent full-time positions for qualifying U.S. workers, and the applicable evidence differs between standalone enterprises and regional-center arrangements. Ask exactly how the project proposes to create the required jobs and what assumptions support that account. A project's marketing or a regional center's designation is not itself a guarantee of either immigration approval or financial performance. Ask which jobs are counted, when they are expected, and what records will demonstrate them. A business plan may project positions, but the investor must understand the difference between a forecast and evidence available at the conditions stage.

02

Document the lawful source and complete path of the capital

Identify how the investor actually obtained the funds and how they will reach the investment. Hypothetical example: a Québec City resident funds the investment from proceeds of a business sale that passed through several accounts before conversion. Retain the sale, ownership and transfer records, and explain any material gap or currency conversion; a final account balance shows the funds are present, not their full lawful history. Prepare a flow chart of the money before assembling narrative statements. It should connect the original lawful event, every account movement, any conversion, and the final transfer to the enterprise or escrow.

03

Read the offering as a genuine financial commitment

Review how the capital will be deployed, the contractual terms, fees and project risks, with independent financial advice as appropriate. Keep the immigration evidence separate from any projected financial return. A claim of a safe investment or a guaranteed immigration outcome should not replace an examination of the actual offering documents, and it is worth asking what happens to the required evidence if the project's plans change. Read the subscription and offering documents for allocation, repayment terms, fees, risks, and investor rights. Those contractual terms inform both the financial decision and whether the capital has the required risk profile.

04

Plan the immigration stages and the household's timeline together

The process generally involves the investor petition, an immigrant visa or adjustment-of-status stage where available, and a later removal-of-conditions step. Visa availability and individual circumstances affect the sequence. Include each family member's age and objectives from the outset; a payment or a filed petition does not, by itself, freeze a child's age, and CSPA and other timing rules need individual assessment. An eligible spouse and unmarried children under 21 may derive status with the investor; EB-5 permanent residence is conditional for two years, with Form I-829 filed in the 90 days before the second anniversary to remove conditions. Keep the immigration calendar separate from construction or operating forecasts. Conditional residence, visa availability, and the later conditions process can each change household timing even when the project remains on schedule.
