A qualifying E spouse is employment-authorized incident to status. The individual's own documentation still needs review, and an EAD is not universally required; dependent children do not gain employment authorization simply from E status.
Plan the household's actual activities, not an assumption
List each family member's citizenship, relationship evidence, age and intended work or study plan. A spouse's employment documentation is a separate question from the investor's ability to operate the enterprise. Discuss any independent employment the spouse plans to pursue and the children's future status questions before assuming a particular household income.
Make the family decision after the enterprise facts are credible, not before. Record each person’s relationship, age, travel plan, and expected activity, and separate a spouse’s work authorization from the children’s options. Hypothetical example: an E-2 investor in a U.S.
instrument-repair workshop plans to bring a spouse who will work at the shop and a twenty-year-old who will attend a design programme. The spouse’s status can carry work authorization, while the child must remain eligible as an unmarried child under 21 and does not gain work permission simply by accompanying. The household should plan around those separate rules before committing to housing or tuition.
