Which transaction documents belong in an initial E-2 review?

THE DIRECT ANSWER

Bring ownership records, the funding history, purchase or formation agreements, and the provisions governing any loans or escrow. Include operational evidence explaining what the enterprise will actually do and how.

Surface conditions before they become binding commitments

Ask who controls the funds at each stage and what happens if a condition is not met. Identify any collateral rather than treating all borrowing the same way. If the agreement is later amended, provide the revised version and explain the change.

Coordinate immigration and transaction advice before signing or transferring funds, since the label escrow alone does not establish that an arrangement meets the requirement. Create a money trail that begins before the transfer and ends with a specific business expense, then pair it with documents showing who will direct operations. The first review should flag any unexplained deposit or unsigned agreement.

Hypothetical example: a Canadian ceramic-supply wholesaler funds a U.S. studio retailer using savings, a loan against a personal condominium, and a seller credit. Bank statements, the loan security, the purchase agreement, and the escrow instructions reveal which funds are personally exposed.

A summary letter alone cannot show that the applicant has truly committed the relevant money.
