L-1B is the intracompany route for an employee whose specialized knowledge of the company's product, service, research, equipment, techniques or management, or advanced knowledge of its processes and procedures, is needed at a related U.S. entity. It shares L-1A's structural rules: a continuous qualifying year abroad within the last three, a parent, subsidiary, branch or affiliate relationship, and two operating entities. It runs five years, gives the L-2 spouse employment authorization incident to status, and forbids placing the employee at a client site as labour for hire. The recurring failure is a petition that proves the employee is excellent at her field without proving she knows something particular to the company.

IN THIS GUIDE · Avoid the general-skill trap when a Shannon simulation specialist is proposed for L-1B

Start with the L-1B eligibility and application overview

01

What usually goes wrong: describing the profession instead of the product

Hypothetical example: a Shannon simulation-and-training software firm proposes to send its senior training-systems specialist to its Florida subsidiary to integrate a new customer's scenario library. The first draft of the petition praises her modelling expertise, her certifications and her years in the industry. That proves general expertise rather than special or advanced company-specific knowledge. The petition must instead explain the firm's own scenario-authoring toolchain, its proprietary data formats and its integration method, and show why her knowledge is special or advanced and needed for the U.S. assignment; it need not prove that U.S. workers are unavailable or that only a few employees possess the knowledge.

02

Compare the knowledge with ordinary company and industry knowledge

USCIS asks how many employees hold the same knowledge and how long it takes to acquire. The firm should state the number of people in the group who can perform the integration unaided, describe the internal training path and its duration, and show the specialist's role in projects where that knowledge was decisive: version histories, design documents she authored, escalation logs. Manager statements should give specifics, not adjectives.

03

Structure the customer-site work so the petitioner stays in control

Training-systems integration often happens at a customer's facility. That is permitted only if the specialist is not principally controlled or supervised by the customer and the placement is not labour for hire. The subsidiary's contract with the customer should show that the firm assigns her tasks, reviews her work and bills for a deliverable, and that she is applying the company's own knowledge rather than filling a seat on the customer's team. Export-control or clearance questions arising from the customer's sector belong with the employer's counsel.

04

Carry the L-1A structural proof unchanged

The qualifying year is shown by payroll and contract; the corporate relationship by share registers; doing business by financial statements, contracts and leases. If the Florida subsidiary is new, the petition is approved for one year and needs premises and capacity to support the role. Count prior L or H time against the five-year ceiling, and note that a specialist who later takes a managerial role may be eligible to change to L-1A and its longer limit.

05

Separate knowledge evidence from the employment calculation

An arrangement essentially supplying labour for hire to an unaffiliated employer raises a separate restriction. Training records, dated process material, examples of unusual problem-solving and evidence of the knowledge’s value to the U.S. operation are more useful than a statement that the employee is simply experienced or trusted. A first review should produce a dated knowledge map: what the employee learned, where it was applied, which record corroborates it and which U.S. duty will use it.
