Twelve months to a real manager: a Shannon drone-inspection firm's first U.S. office under L-1A

THE SHORT ANSWER

A new-office L-1A is approved for one year on the strength of secured premises, the parent's financial ability to support the office, and a business plan showing the transferee will be managing staff or an essential function by the end of that year. The extension then asks whether that plan happened. A Shannon firm opening its first U.S. office must therefore treat the first twelve months as an evidence-gathering exercise from the day the manager lands.

01

Meet the three new-office conditions on paper before filing

Hypothetical example: a Shannon company that provides drone-based infrastructure inspection to utilities and contractors forms an Arizona subsidiary and proposes to send its operations lead to open it. The petition needs a signed lease for real commercial premises in the subsidiary's name, evidence that the Québec parent has the funds to pay the office's costs and the manager's salary for the year, shown by financial statements and a capitalization transfer, and a business plan with a twelve-month staffing timeline. The operations lead must have a continuous qualifying year with the parent in a managerial or executive capacity, and the parent-subsidiary link must be proven by share registers.

02

Write the staffing plan so the manager is a manager by month twelve

USCIS accepts that a new office's manager may be hands-on at first, but the extension will look for subordinate staff or a managed essential function by the end of the year. The plan should name the roles to be hired, pilots, a data analyst, a scheduler, with months and wages, and show the contracts or pipeline that fund them. If the honest projection is one employee for two years, L-1A is premature and the office should be opened another way first. The customer sector may impose regulatory or airspace requirements; those belong with the company's operational counsel, not in the immigration petition, but the plan should not depend on approvals that have not been sought.

03

Run the first year as the extension file

From the first month the subsidiary should keep payroll records, hiring letters, customer contracts, invoices, bank statements and an organizational chart updated as staff join. The extension petition, filed before the first anniversary, will compare the plan with the record, and a well-kept file makes that comparison easy. The manager's spouse holds L-2 status with employment authorization incident to status; children may study until 21. L-1A time counts toward seven years, and a permanent posting may later support an EB-1C multinational manager petition, for which the same records serve. Diarize the extension filing at least three months before the year ends.
