One Boischatel household, two passports: why the permanent resident and the citizen take different U.S. routes

THE SHORT ANSWER

Canadian citizenship and Canadian permanent residence are different legal facts and open different U.S. doors. TN and E-2 require citizenship; L-1 and EB-5 do not. When a Boischatel couple holds one of each, the route for the household is set by whichever partner would do the U.S. work or make the investment, and the other's status follows as a dependant. Record each passport before comparing any category.

01

Write down what each person actually holds

Hypothetical example: a Boischatel construction estimator is a French citizen who has held Canadian permanent residence for six years and has not yet applied for citizenship; his wife is a Canadian citizen working as a nurse. He receives an offer from a U.S. general contractor. TN is closed to him because he is not a Canadian or Mexican citizen, and his PR card changes nothing in the U.S. analysis. His French citizenship is what a U.S. officer will read, and it may open other doors: France is an E treaty country, and L-1 does not depend on nationality at all. The wife's Canadian citizenship gives her TN access in her own profession if a U.S. employer wants her.

02

Decide which partner is the principal and let the route follow

If the estimator's offer is the reason to move, the household should examine L-1 through his current employer if it has a U.S. affiliate, or an employer-sponsored route the contractor can support, and the nurse would accompany as a dependant with whatever work rights that status carries. If instead the nurse's profession is the stronger U.S. opportunity, she can pursue TN as a registered nurse, but her husband would then hold TD status, which does not permit employment, and his own work plans would need a separate answer. The principal's route determines everyone's rights, so the choice of principal is a decision, not a default.

03

Do not let a pending citizenship application drive the timeline

A Canadian citizenship application in progress does not create eligibility, and no U.S. route waits for it. If the estimator expects a citizenship ceremony within the year, the household can plan a TN application after that date, but must not sign a U.S. offer contingent on it. Meanwhile, absence from Canada while on a U.S. assignment can affect the PR residency obligation and the citizenship application's physical-presence count, which are Canadian questions to raise with a Canadian adviser. Keep both countries' rules on one timeline so that solving the U.S. side does not quietly damage the Canadian one.
