FOR PROFESSIONALS · BOISCHATELBoischatel

Your talent.A bigger stage.

For a Boischatel engineer, technologist or surveyor, TN eligibility is usually decided by one document: the credential the listed USMCA profession demands. TN is open to Canadian and Mexican citizens who have prearranged professional work with a U.S. employer in an occupation on the USMCA Appendix 2 list, and each occupation carries its own qualification rule. Canadian citizens may present themselves at a port of entry or preclearance site, or the employer may file Form I-129, and they generally do not need a TN visa stamp. Self-employment in the United States is not permitted, so an owner of the hiring company needs that stake reviewed before anything else.

IN THIS GUIDE · Let the licence or degree, not the job title, decide whether a Boischatel professional fits TN

Start with the TN eligibility and application overview

01

Identify which listed profession the duties actually describe

Hypothetical example: a Boischatel structural engineer, a member of the Ordre des ingénieurs du Québec, is offered a bridge-inspection role by a Vermont consultancy. The Engineer profession accepts a baccalaureate or a state or provincial licence, so her licence and her degree both satisfy the rule. Her colleague, a technologist with a DEC, cannot rely on Engineer; the closer category is Scientific Technician/Technologist, which has its own conditions about working in direct support of a professional. The duties decide the category; the category decides the credential.

02

Read the qualification rule for that profession, not a neighbouring one

Appendix 2 is specific. Some occupations accept a post-secondary diploma plus three years of experience; others accept only a baccalaureate; a few accept a licence in place of a degree. A rule that helps one profession is not portable to another. Before ordering an evaluation of a Québec diploma, confirm that an evaluation is what the profession's rule actually calls for. Bring the original credential, the transcript and any professional-order membership card, and keep them together with the offer.

03

Confirm the employer will sign what the port of entry expects

The employer's letter should state the professional position, the duties, the duration, the remuneration and the credential relied on. If a staffing intermediary sits between the Boischatel applicant and the site where work happens, disclose it; the letter must come from the entity that actually employs. Any shares or partnership interest in the U.S. company must be named, because a controlling owner can look self-employed even when a salary is paid.

04

Choose between the port of entry and an I-129 petition deliberately

A Canadian citizen can seek TN admission on the day of travel, but that convenience means the officer's questions are answered live. An I-129 filed by the employer produces a written decision before departure and suits complicated credentials or prior refusals. Either way, the applicant must not begin U.S. work before admission in TN status, and remote work for the U.S. employer from Boischatel is a separate question to raise with counsel.
