IN THIS GUIDE · Pin down the Boischatel specialist's special or advanced knowledge of the company's own product, process or procedures
Start with the L-1B eligibility and application overview
Sequence the explanation: the product first, the person second
Hypothetical example: a Boischatel building-automation contractor has developed its own configuration library for the controls it installs in institutional buildings, and its commissioning specialist wrote most of it. Before describing him, the petition should explain what the library is, why it is proprietary, and what a controls technician hired in the United States would not know. Only then does his history make sense: years of building and maintaining the library, training installers, and resolving faults nobody else could. Specialized knowledge is proven in that order. Hypothetical example: a Boischatel microbrewery uses an in-house fermentation scheduling system, and its process steward is proposed for the affiliated U.S. operation. The useful question is not whether she is an experienced brewer. It is whether controlled records show that she created the system, other brewers receive internal training on it, and the affiliate needs her to install it rather than merely fill a production shift. The first review should request the workflow records, training roster, and a manager's explanation of the specific deployment.
Distinguish company knowledge from trade competence
Every commissioning technician can read a sequence of operations and tune a loop. That is the trade, and it does not qualify. What qualifies is knowledge of this company's methods, tools and standards that is not generally found in the industry and that the U.S. entity genuinely needs. Document it with internal manuals, version histories, training records and statements from managers explaining how long a new hire takes to reach the same level.
Prove the year abroad and the corporate link with the same rigour as L-1A
The qualifying year must be continuous and with a group entity; payroll and the employment contract prove it. The Boischatel company and the U.S. entity must be parent, subsidiary, branch or affiliate, shown by ownership records. Both must be doing business. If the U.S. entity is newly formed, the petition is approved for one year initially and must show premises and the capacity to support the specialist's role.
Watch the client-site rule if the work happens on someone else's premises
Many controls and engineering specialists work at customer buildings. That is permitted only if the specialist is not principally controlled or supervised by the client and the placement is not labour for hire. The petition should show that the Boischatel group assigns the work, evaluates it and pays for it, and that the specialist applies the company's own knowledge there rather than filling a client vacancy.
