SAINTE-BRIGITTE-DE-LAVAL · STAFFING CHANGE EXERCISE

A delayed first hire: documenting the effect on the proposed manager

USAvisa field guide · 2 minute read Reviewed 7 September 2026
THE SHORT ANSWER

Use a staffing delay to examine who is actually doing the work. This is an evidence exercise, not a rule that a particular headcount qualifies a new office. A managerial or executive position must be assessed from the operation and responsibilities the evidence supports. A new-office filing is a decision to document an operating launch, not simply an executive’s intention to explore a market. Hypothetical example: a Québec maker of precision irrigation valves wants to send its general manager to establish a U.S. office, but the intended site is only a mailbox and the first technician has not been hired. The company should decide whether to secure usable premises and a realistic staffing plan before filing. The transferee also needs the qualifying year abroad, and the entities must have the required corporate relationship.

01

List the tasks left uncovered

Hypothetical example: an operations hire declines an offer before joining. Identify the duties that person was expected to take over, the interim person responsible, and the evidence of the revised arrangement. Do not describe a vacant position as occupied merely because a signed offer once existed. List the tasks by role and identify which are covered at launch, which are outsourced, and which remain with the transferee. This gives the business a factual basis for deciding whether the proposed role is genuinely managerial after the office starts.

02

Measure the change in the beneficiary’s week

Compare the proposed allocation of duties with the actual interim schedule. Explain whether the beneficiary is directing work, performing operational tasks, or doing both. Keep contemporaneous records that help a reviewer understand the change; do not invent percentages after the fact to fit a preferred description. Compare the proposed executive’s week before and after staffing begins. If the plan requires the person to do nearly all sales, service, and production work indefinitely, the organization chart and hiring plan need reconsideration.

03

Review consequences before relying on the old plan

Bring the staffing change, business activity records and approval dates to the reviewer together. Initial new-office approval is limited to one year. A recruitment setback is neither an automatic refusal nor proof that an extension will be granted; the resulting role and evidence require assessment. Record consequences if a lease, capitalization, first contract, or intended hire changes. A new-office plan remains credible when it describes its dependencies honestly and is updated before a material fact is presented to USCIS.
