L-1B transfers an employee with specialized knowledge from a foreign company to a related U.S. entity for up to five years. The statute defines specialized knowledge as special knowledge of the company's product, service, research, equipment, techniques, management or other interests and its application in international markets, or an advanced level of knowledge of the company's processes and procedures. The applicant needs one continuous year of qualifying employment with the group abroad in the preceding three, a qualifying corporate relationship, and a U.S. entity that is doing business. For a Sainte-Brigitte-de-Laval specialist in a technical firm, one or more internal records may help show how the knowledge was acquired and how the U.S. assignment will use it. The knowledge need not be proprietary, unique or held by only a few employees, and the case is assessed on the totality of the evidence. A first review can make a dated proof grid: payroll dates in one column, ownership instruments in another, the company artifact in a third, and the U.S. project record beside them. Marking each item as obtained, missing, or inconsistent makes the filing decision concrete. It stops an elegant duty letter from disguising a gap in the records beneath it.

IN THIS GUIDE · Identify the one internal record that proves a Sainte-Brigitte-de-Laval analyst's knowledge is specialized

Start with the L-1B eligibility and application overview

01

Look for the artifact that only the company could have produced

Hypothetical example: a Sainte-Brigitte-de-Laval GIS analyst at a forestry-mapping firm built the company's proprietary yield-prediction model, which combines the firm's own field data with a modelling approach it developed over years. The model's design documentation, with its revision history and her name on it, is the deciding record. A description of her skills in geospatial software is not, because those skills are available in the market.

02

Show how few people hold it and how long it takes to acquire

USCIS compares the applicant's knowledge with that of other employees and the industry as part of the totality of the evidence. A technical director's memo may explain who holds comparable knowledge, how the applicant acquired it, and whether imparting it would require significant time, cost or disruption. Those are relevant factors, not standalone thresholds, and L-1B does not require proof that a U.S. hire is unavailable.

03

Tie the U.S. assignment to that knowledge

The petition must explain why the U.S. entity needs this knowledge now: a new client contract, a product roll-out, a system migration. Attach the contract or project plan. If the transferee would spend most of the time at a client's premises, show the petitioner keeps control over her work and that the placement is not labour for hire, using the service agreement and reporting lines. Before the assignment letter is signed, compare its milestones with the knowledge record and with the client agreement. The filing should identify the deliverable that calls for the specialist, not merely a projected need for extra personnel. Hypothetical example: a Sainte-Brigitte-de-Laval process engineer at a recycled-fibre packaging manufacturer developed the firm's closed-loop coating-change procedure. Its Ohio affiliate has bought a line that must be converted to the same procedure before a customer's packaging run. The purchase order, implementation schedule, internal procedure and training roster connect the assignment to her knowledge; a generic statement that the affiliate is busy does not. If the client can direct the engineer's daily tasks or substitute her into its production crew, the arrangement needs correction before filing because that fact may be incompatible with an L-1B placement.

04

Complete the corporate and dependant picture

The qualifying relationship and doing-business evidence are the same as for L-1A. L-2 spouses are employment-authorized incident to status; children may study, cannot work, and lose status at 21. L-1B is capped at five years, and years in L-1B count toward the L-1A seven-year limit if the transferee is later promoted to a managerial role.
