Read the general life across the border overview
A spouse who is herself a Canadian citizen in a listed profession does not have to accept dependant status. She can hold her own TN, with her own employer letter and qualification, and the household then contains two principals whose admissions are independent. That solves the TD no-work problem but creates two files, two renewal cycles and two sets of employer dependencies. Children remain dependants of one parent. Decide which structure fits before either spouse accepts an offer.
Compare dependant status with a second principal application
Hypothetical example: a Sainte-Brigitte-de-Laval dietitian accepts a TN position with a U.S. hospital, and her husband, a physiotherapist, wants to work too. As a TD dependant he may study but not work. As a TN principal in his own right, physiotherapy being a listed profession, he can work for a U.S. employer that provides a support letter, provided he meets the entry's qualification rule and any state licence requirement. The comparison is practical: TD is quick and requires only proof of the marriage, but forecloses his career for the duration; TN requires him to find an employer, obtain a licence and present his own file, but gives him independent status. The couple should also check that neither role involves self-employment, since a physiotherapist planning a private practice in the United States would not fit TN at all.
Understand what independence means for renewals and children
Two principals mean two admissions with potentially different expiry dates, two employer letters to refresh, and two sets of facts that can change. If one spouse loses their job, their TN ends and they must either find new qualifying employment, change to dependant status under the other spouse, or leave; the change to TD is a filing with its own timeline, not an automatic fallback. Children can only be dependants of one parent, so the household should choose the parent whose employment is more stable and whose admission period is longer, and keep the children's admission aligned with that parent at each renewal. Each child's age should be checked against the 21-year cutoff and the expected total stay, since dependant status ends at 21 or on marriage.
Sequence the two applications and the move
The dietitian's application can proceed first, since her offer is firm. The physiotherapist should not enter as a TD dependant and then attempt to work while waiting for his own TN; work on TD is unauthorized and would compromise both spouses. The better sequence is for him to obtain the state licence and a U.S. employer letter, then present his own TN application, whether at a port of entry or through an I-129 petition, and to enter as a principal. If his licence will take longer than her start date, he can enter as TD, study or prepare, and later change status to TN or leave and re-enter as a TN principal, but he should not work in the interval.
