IN THIS GUIDE · Separate the trail-building method from the machine skill before a Stoneham-et-Tewkesbury builder is sent to a U.S. state park
Start with the L-1B eligibility and application overview
Name the knowledge and show it belongs to the company
The statute describes special knowledge of the company's product and its application in international markets, or an advanced level of knowledge of the company's processes and procedures. Describe the specification as a company process: who wrote it, what it changed about how crews build, how it is documented, and why a builder hired from outside could not apply it without months of training. Provide the specification manual or its table of contents, its version history and the training records showing the senior builder taught it. Avoid claiming that the knowledge is unique in the industry; the test is whether it is the company's own and whether his command of it is advanced.
Keep excavator skill out of the specialized-knowledge claim
Every reviewer will notice that trail building is physical, seasonal work, and the file should not pretend otherwise. Separate the two layers plainly: machine operation, rock work and finishing are general skills; sequencing a build to the firm's drainage rules, setting out grade reversals from the design drawings and signing off sections against the specification are the specialized part. Describe how many hours of the Vermont assignment go to each, and show that the affiliate needs him because of the second layer. A job description that reads like an equipment-operator posting will fail on its own terms.
Document control of the work on state-park land
The state agency owns the trail corridor and inspects the result, but it must not be the entity directing his daily work. Ask the affiliate for its contract with the state and confirm that the affiliate assigns tasks, supervises the crew, supplies the equipment and pays him. Add a letter from the affiliate explaining site supervision and reporting lines. If the contract language gives the agency day-to-day control over personnel, it needs to be revised before filing, because an offsite placement that looks like labour for hire will not be approved.
Confirm the year, the relationship and the five-year ceiling
Establish his continuous year with the Québec firm from payroll records, keeping in mind that trail crews are often laid off between seasons; a break inside the last twelve months resets the count. Prove the Québec firm's ownership of the Vermont affiliate with share records and show both entities actively operating. L-1B is limited to five years in total, and if the affiliate later wants him to manage its crews, a change to L-1A would be a fresh analysis rather than an automatic upgrade. His spouse in L-2 status is employment-authorized incident to status.
