L-1B is the specialized-knowledge branch of the intracompany transfer category. The employee must have worked for the group abroad for one continuous year within the last three, the Québec and U.S. entities must be related in a qualifying way, and the U.S. role must use knowledge of the company's own product, process or procedures that is special or advanced rather than skill that any experienced worker in the trade would have. For a machining or fabrication business near Sainte-Catherine-de-la-Jacques-Cartier, the risk is describing a good employee rather than a specific body of knowledge. The review is built around three questions: what does this person know that the company itself developed, how did they acquire it, and why does the U.S. assignment need it now. The category lasts up to five years in total.

IN THIS GUIDE · Describe the company-specific knowledge a Sainte-Catherine-de-la-Jacques-Cartier technician carries, in terms a stranger can verify

Start with the L-1B eligibility and application overview

01

Sequence the evidence from the knowledge outward

Hypothetical example: a CNC programmer at a precision-machining shop in Sainte-Catherine-de-la-Jacques-Cartier wrote the shop's fixture-programming routines for a line of aerospace brackets and is asked to set up the same line at a U.S. affiliate. Begin with the routines themselves: when they were written, which parts they serve, and which internal documents describe them. Then show the programmer's role in creating and maintaining them through version histories and project records. Only then draft the duty description, so it grows out of evidence rather than the other way round.

02

Separate proprietary knowledge from trade skill

General CNC programming skill is not specialized knowledge by itself. The file should identify the claimed special knowledge of the company's product or its application, or the advanced knowledge of its processes and procedures, and show how the employee acquired and will use it. Training records, internal manuals and comparisons with similarly employed workers may help, but the knowledge need not be proprietary or unique, and the petitioner does not have to prove that it is unavailable in the U.S. labour market.

03

Handle client-site work honestly

If the affiliate will place the programmer at a customer's plant, the petition must show that the petitioner still controls the work and that the assignment is not simply supplying labour to the client. Describe who assigns tasks, who evaluates performance and who can end the placement. Include the service agreement between the affiliate and the customer, and check that its language matches the account of control. Offsite work is not prohibited, but an arrangement that reads as staffing will be treated as one.

04

Keep the transfer conditions in the same file

Specialized knowledge alone establishes nothing without the qualifying relationship and the continuous year abroad. Add the ownership records for both entities, payroll for the qualifying year, and evidence that the Québec shop and the U.S. affiliate both operate. If the programmer's duties are partly supervisory, consider whether L-1A fits better on the facts rather than filing L-1B because it seems easier; the categories have different time limits and different evidence.

05

Ask whose product or process the knowledge concerns

Deep skill in a widely sold platform, however scarce good practitioners may be, generally belongs to the industry rather than to the employer, and vendor training certificates argue against the petition as often as for it. A controlled workflow, revision history, and documented exceptions may substantiate process knowledge; product-release records and cross-border implementation material may substantiate knowledge of the offering. The decision maker needs a comparison between standard industry skill and the applicant’s developed understanding of the organization’s methods.
