FOR PROFESSIONALS · LÉVISLévis

Your talent.A bigger stage.

TN is open to Canadian and Mexican citizens who have prearranged professional work in an occupation listed in Appendix 2 of USMCA and who hold the degree, licence or experience that the specific listing demands. For a Lévis engineer, technologist or analyst, the decisive document is rarely the offer letter; it is the comparison between what the U.S. employer needs done and the wording of the listing. Self-employment in the United States is not permitted under TN, so a contractor who would be their own U.S. employer has a different problem to solve. Canadians may present the case at a port of entry or preclearance, or the employer may file an I-129, and no visa stamp is needed. This page walks through the facts that usually decide the outcome.

IN THIS GUIDE · Let the Appendix 2 profession, not the plant's job title, decide whether a Lévis TN case exists

Start with the TN eligibility and application overview

01

Compare the U.S. need with the listing, word by word

Hypothetical example: a Lévis industrial engineer with a bachelor's degree is recruited by a U.S. metal-fabrication plant to redesign its production flow. The posting calls the job production supervisor. Ask the employer what the person will spend most weeks doing: if the core work is analysing processes and designing systems, the engineer listing may fit; if it is directing shift workers, the listing may not, whatever the title says. The fit is decided by duties against the listing, and the file should show that comparison openly.

02

Check the qualification rule that belongs to that one profession

Each Appendix 2 occupation carries its own qualification: some accept only a degree, some a provincial licence, some a post-secondary diploma plus years of experience. A Lévis applicant who is a member of the Ordre des ingénieurs du Québec should still confirm which credential the listing names, since order membership and a degree are not interchangeable in every case. Order the transcript, diploma and licence records in the form the listing calls for, and translate only what an officer will need to read.

03

Establish who the employer is

TN requires a U.S. employer or entity to engage the professional; a Lévis consultant who would invoice through their own company for work they control is looking at self-employment, which TN does not allow. Disclose any staffing agency, any client site and any ownership in the engaging business. A minority shareholding does not automatically disqualify, but it must be on the table so the self-employment line can be drawn accurately.

04

Choose the process and prepare for the questions it invites

A Canadian citizen can apply at the border with the support letter, credentials and proof of citizenship, or the employer can petition USCIS by I-129 in advance. Border adjudication is fast but happens in one conversation; a petition is slower and paper-based. Whichever path is used, the applicant should be able to explain the duties, the qualification and the employer chain without reading from the letter, and should carry originals rather than photographs.
